The rules for using Ownmades

Welcome to Ownmades. We help connect customers with home chefs and other food businesses offering home-cooked meals and related services (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the Services.

These Terms should be read together with our Privacy Policy, which explains how we collect and use personal data.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use the Services.

• You agree to provide accurate, complete, and up-to-date information when creating and maintaining your account (the "Account").
• You are responsible for all activity on your Account and for keeping any login credentials secure.
• You must notify us promptly if you suspect unauthorized access or use of your Account.

Ownmades provides a platform that facilitates listings, discovery, ordering, payment facilitation, and communications between users.

• Unless expressly stated otherwise, we do not prepare, cook, store, or package food.
• Sellers are responsible for the items they offer, including descriptions, ingredients, allergens information they provide, licensing/compliance where applicable, and fulfillment.
• Customers are responsible for reviewing item information and making purchase decisions.

When you place an order, you are making an offer to purchase items from a seller in accordance with the listing, these Terms, and any additional terms displayed during checkout.

• Availability, preparation time, and delivery windows are estimates and may change.
• Delivery may be carried out by sellers, Ownmades, or third-party logistics partners, depending on the option you select and availability.
• You are responsible for providing accurate delivery details. Failed delivery due to incorrect details or unavailability at delivery may result in fees or loss of the order, subject to applicable law.

Prices are shown before you confirm an order and may include taxes, delivery fees, and service fees (if any), as displayed at checkout.

• Payments may be processed by third-party payment providers (for example, Stripe) and may be subject to their terms.
• You authorize us and our payment partners to charge your selected payment method for the total amount shown at checkout.
• If a payment fails or is reversed, we may suspend or restrict access to the Services until the issue is resolved.

Because food is time-sensitive and made-to-order, cancellations, refunds, and adjustments depend on order status, seller policies, and applicable law.

• If you believe there is an issue with an order (for example, missing items or wrong items), contact support through the app as soon as possible.
• Chargebacks or payment disputes may result in temporary or permanent account restrictions.
• We may investigate issues and, where appropriate, provide refunds, credits, or other remedies at our discretion and in accordance with applicable law.

Food items may contain allergens and may be prepared in environments where cross-contact can occur.

• Customers are responsible for reviewing listing details, communicating dietary requirements, and making choices appropriate for their needs.
• Sellers are responsible for the accuracy of ingredient and allergen information they provide.
• Ownmades does not provide medical advice and does not guarantee that any item is allergen-free.

You may be able to submit content such as reviews, ratings, photos, and messages (collectively, "User Content").

• You represent that you have the rights to post your User Content and that it does not violate any law or third-party rights.
• You grant Ownmades a non-exclusive, worldwide, royalty-free license to host, use, reproduce, modify, and display your User Content for operating and improving the Services.
• We may remove User Content that violates these Terms or that we believe is harmful, misleading, or inappropriate.

You agree not to misuse the Services. This includes, without limitation:

• Violating any applicable law or regulation.
• Impersonating others or providing false information.
• Attempting to bypass security, access controls, or rate limits.
• Scraping, crawling, or extracting data without our written permission.
• Harassment, hate speech, threats, or abusive behavior toward others.
• Posting or transmitting malware, spam, or other harmful content.
• Using the Services to facilitate fraud or other illegal activity.

The Services, including trademarks, logos, designs, text, graphics, and software, are owned by or licensed to Ownmades and are protected by intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works based on the Services or any part of them, except as permitted by applicable law or with our written consent.

The Services may integrate with or link to third-party services (for example, payment processors, map providers, or analytics services). We do not control these third-party services and are not responsible for their content, policies, or practices.

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Ownmades disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be uninterrupted, secure, error-free, or that listings, content, or information provided by sellers or users is accurate or complete.

To the maximum extent permitted by law, Ownmades will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses arising out of or related to your use of the Services.

To the extent liability cannot be excluded, Ownmades's total liability for all claims related to the Services will be limited to the amount you paid to Ownmades (if any) for the Services giving rise to the claim in the three (3) months before the event that led to the claim.

We may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms, created risk, or may cause harm to Ownmades or other users.

You may stop using the Services at any time. Certain sections of these Terms will survive termination, including ownership, disclaimers, limitation of liability, and indemnity.

We may update these Terms from time to time. If changes are material, we may provide notice through the Services or by other means. Your continued use of the Services after the effective date of the updated Terms constitutes acceptance of the updated Terms.
